OS DIREITOS FUNDAMENTAIS SOCIAIS NA TEORIA DE ROBERT ALEXY /THE FUNDAMENTAL SOCIAL RIGHTS IN ROBERT ALEXY’S THEORY

RESUMO: O objeto de estudo desta investigação é a questão dos direitos fundamentais sociais, especificamente a forma como tais direitos são concebidos na doutrina do célebre jusfilósofo alemão Robert Alexy. Os direitos fundamentais sociais são, no atual contexto brasileiro, carentes de efetividade, e a teoria de Robert Alexy certamente pode contribuir para a adequada compreensão das normas constitucionais que garantem esses direitos, bem como para que elas sejam aplicadas corretamente, o que justifica a investigação. Na primeira parte, é analisado o desenvolvimento histórico dos direitos fundamentais sociais, bem como a sua previsão na atual Constituição da República Federativa do Brasil. Na segunda parte, são trabalhadas as ideias fundamentais de Robert Alexy relativamente a tais direitos, com a análise de conceitos como o de regra, o de princípio, o de ponderação, o de proporcionalidade e o de mínimo existencial. A terceira parte é dedicada à análise crítica de importante julgado do Supremo Tribunal Federal sobre o tema.

ABSTRACT: The object of study of this investigation is the matter of the fundamental social rights, specifically the way such rights are thought in the doctrine of the German legal philosopher Robert Alexy. There is a lack of effectiveness of the fundamental social rights in the present Brazilian context, and the constitutional rules regarding those rights certainly can be better understood and applied through the Robert Alexy’s theory. The first part involves the historical development of the fundamental social rights and its ruling through the current Constitution of the Federative Republic of Brazil. The second part analyzes the Robert Alexy’s most important ideas about the fundamental social rights, for instance, the concepts of rule, principle, balancing, proportionality and existential minimum. The third part involves a critical analysis of an important precedent of the Brazilian Federal Supreme Court in this field.
