Culturalismo punitivista e a não recepção dos crimes eleitorais pela Constituição republicana

Temos hoje, no Brasil, uma vasta produção legislativa de cunho penal. Assevere-se que em todos os ramos do ordenamento jurídico existe, pelo menos, algum ponto correlacionado ao drástico campo legislativo - direito penal. Não sem razão o é também no direito eleitoral. Criado sob os auspícios de um Estado totalitário, o Código Eleitoral perfaz uma verdadeira carta ao malferimento das garantias fundamentais ao limite estatal de punir. Tipos penais criados sem o menor critério de certeza e estrita necessidade acabam por revelar um espírito incentivador da legislação simbólica. Por essa razão e ancorada nessa ideia de que um sistema de justiça penal eficiente parte de tipos penais claros, propomos que, no modelo republicano de 1988, não há espaços para criações despiciendas.

It should be noted that in all branches of the legal system, there is at least some point related to the drastic legislative field - criminal law. Not without reason it is also in the electoral law. Created under the auspices of a totalitarian state, the Electoral Code is a true letter to the violation of fundamental guarantees to the state limit of punishment. Criminal types created without the slightest criterion of certainty and strict necessity end up revealing a spirit that encourages symbolic legislation. For this reason and anchored in this idea that an efficient criminal justice system starts from clear criminal types, we propose that, in the 1988 republican model, there are no spaces for despicious creations.
